EIGHT LINERS CONDEMNED BY THE DEPARTMENT COMMANDER
The American Legion, Department of Texas, has been embarrassed on two
occasions recently by having its name publicized in an unfavorable way, due
to American Legion Posts operating Eight Liners. When these machines
are played for a monetary value such as a gift card, credit card, or any
other device that may be exchanged for anything of value, these machines are
ILLEGAL, period. The Texas Supreme Court has so ruled. There
is no legal way around that fact.
Some unscrupulous individuals will try to convince your Post that there
is an easy way around the law for you to make big bucks by working with them
and using The American Legion name to operate a game club either off
premises or at your American Legion Post. Not only can local law
enforcement bring sanctions to the post but the American Legion, Department
of Texas, can and will discipline a post under the code of procedures when a
post is involved in such an illegal operation.
I realize that most posts have good intentions when they allow these
machines to be sponsored by their post. They receive money for their
post charities or it's their way to help the post meet financial
obligations. I must point out the way to hell is paved with good
intentions.
There has been considerable information distributed by the Department of
Texas to all posts explaining the law and the Department Judge Advocate has
written an opinion on the subject which was also provided to each post.
It all comes down to one simple fact. When these machines are operated
in any manner that results in a pay off of a monetary value they are
ILLEGAL, yet some posts still choose to ignore the law.
Let me put it another way. If a post is sponsoring these machines
in any location and you or any representative of your post is paying off in
any way except a FUZZY BEAR you are subject to sanction from both the local
law enforcement and The American Legion, Department of Texas. If you
bring discredit to The American Legion by operating these machines, you will
suffer the fullest consequences.
Legionnaires, I don't know how I can make it any plainer. Please
don't let your post be the next one to embarrass The American Legion.
